1. Seller and Scope of Application

These General Terms and Conditions of Sale apply to purchases made on mylmelo.com by individuals acting as consumers.

The seller is Mylièse Rolland, a sole proprietor (EI), operating under the trade name myl & melo.

2. Proposed Designs

The store offers artwork and textile creations. The key details of each item—including its dimensions, materials, and price—are listed in its product description.

Offers are valid while supplies last.

The photographs depict the products as accurately as possible. Color display may vary depending on the screen; this clarification does not limit the legal warranties to which the customer is entitled.

3. Price

Prices are listed in euros. Any shipping charges are specified before the order is finalized.

The total amount due is shown in the order summary. The applicable price is the one displayed at the time of the order.

4. Shipping and Delivery

Available items are prepared and handed over to Colissimo within a maximum of seven calendar days after payment is confirmed.

The destinations served, shipping costs, and total delivery time are listed in the selected shipping option before the order is finalized.

This total timeframe is expressed in calendar days starting from the date of payment confirmation. It includes order preparation and shipping until delivery to the customer. The seven days required for preparation are therefore included in the stated timeframe.

A tracking number is provided to the customer upon shipment.

In the event of a delay, a damaged package, or a delivery issue, the customer may contact myl & melo at mylmelo@hotmail.com so that we can follow up on the issue with the carrier.

The risk of loss or damage to the goods passes to the customer when the customer physically takes possession of the package, or when a third party designated by the customer—other than the carrier—takes possession of it.

5. Order

The customer selects the desired items and adds them to their cart. They enter the information needed to place the order, then choose from the available delivery and payment options.

Before confirming the order, the customer can review the order details, the total amount, and their contact information, and correct any errors.

Final confirmation constitutes a payment obligation. An order confirmation is sent to the customer by email.

If a custom order turns out to be unavailable, the customer is notified promptly. Any payment already received for that order and the corresponding shipping costs are refunded to the customer. No replacement is made without the customer’s consent.

6. Payment

Payments are processed by Squarespace Payments, with Stripe as the transaction processing provider.

Customers can use the payment methods displayed when placing an order. Their availability may vary depending on the country, the device used, and the terms and conditions of the relevant service provider.

When a Klarna option is offered, its use is subject to Klarna’s approval and to the terms and conditions presented to the customer before the payment is confirmed, including the payment schedule and any applicable fees.

If payment is declined, the order cannot be completed using that payment method.

7. Right of Withdrawal

The customer has fourteen days from the day after receiving the order to exercise the right of withdrawal, without having to provide a reason for the decision. If multiple items from the same order are delivered separately, this period begins the day after the last item is received.

If the deadline falls on a Saturday, Sunday, or holiday, it is extended to the next business day.

The customer may notify us of their decision by email at mylmelo@hotmail.com, using the withdrawal form provided with these terms and conditions, or by any statement that clearly expresses their intention to withdraw.

The fact that a creation is unique or handmade does not negate this right. The exception applies to goods made to the customer’s specifications or that are significantly personalized.

The customer must return the item no later than fourteen days after notifying us of their decision to cancel the purchase, to the following address:

The artwork must be carefully packaged to ensure it is protected during shipping.

The customer is responsible for the direct return shipping costs when exercising the right of withdrawal.

This provision does not apply to returns covered by the seller under statutory warranties, particularly in cases of defective or nonconforming products.

Refund

In the event of a cancellation, myl & melo will refund the amounts paid for the items in question, as well as the applicable standard shipping costs. Additional costs associated with choosing a shipping method that is more expensive than the standard option offered will not be refunded.

The refund will be issued no later than fourteen days after notification of the cancellation. However, it may be deferred until the items are returned or until proof of their shipment by the customer is received, whichever comes first.

Refunds will be issued using the same payment method used for the purchase, unless the customer expressly agrees to use a different method, at no additional cost.

8. Statutory Warranties

The items sold are covered by the legal warranty of conformity and the warranty against hidden defects, under the conditions provided by law. These warranties also apply to personalized items.

Customers are asked to describe the problem they are experiencing and, if possible, to attach photographs to help us review their request.

Compliance is provided at no cost to the customer, including any necessary shipping costs.

Terms and Conditions of Sale

The consumer has two years from the date of delivery of the goods to invoke the statutory warranty of conformity in the event that a lack of conformity arises. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it first appeared.

When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to such digital content or digital service throughout the entire period of supply provided for in the contract. During this period, the consumer is required only to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it first appeared.

The statutory warranty of conformity imposes an obligation on the seller, where applicable, to provide all updates necessary to maintain the conformity of the good.

The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them.

If the goods are repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty.

If the consumer requests repair of the item but the seller insists on replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while retaining the item or terminate the contract by receiving a full refund upon return of the item, if:

1° The seller refuses to repair or replace the item;

2° The repair or replacement of the item occurs after a period of thirty days;

3° The repair or replacement of the item causes significant inconvenience to the consumer, particularly when the consumer is permanently responsible for the costs of returning or picking up the nonconforming item, or if the consumer bears the costs of installing the repaired or replacement item;

4° The nonconformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to rescission of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. In such cases, the consumer is not required to first request repair or replacement of the goods.

The consumer is not entitled to rescind the sale if the lack of conformity is minor.

Any period during which the goods are out of service for repair or replacement suspends the warranty period remaining until the goods are returned in working order.

The rights mentioned above arise from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code.

A seller who, in bad faith, obstructs the enforcement of the legal warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of the average annual revenue (Article L. 241-5 of the Consumer Code).

The consumer is also entitled to the statutory warranty against hidden defects pursuant to Articles 1641 through 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the item is retained, or to a full refund upon return of the item.

If a prior written complaint has gone unanswered or has failed to resolve the dispute, the customer may, free of charge, contact the consumer mediator responsible for myl & melo:

The request for mediation must be filed within one year of the written complaint submitted to myl & melo, subject to other legal conditions for admissibility.

Mediation is optional. The parties remain free to accept or reject the proposed solution and to bring the matter before the competent court.
